Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of our services and products, provided by Harris Creations (Pty) Ltd, a custom furniture company based in Durban, South Africa. By placing an order with us, you agree to be bound by these Terms, which comply with the Consumer Protection Act, 2008 (“CPA”).

1. Custom Orders

1.1 All furniture is made to order and tailored to the specifications agreed upon at the time of purchase.

1.2 A detailed design confirmation (including dimensions, finishes, and materials) is required before production begins.

1.3 Changes requested after confirmation may lead to additional charges and/or extended lead times.

2. Pricing and Payment

2.1 All prices are quoted in full, charged in South African Rands (ZAR), and include VAT unless otherwise stated.

2.2 A non-refundable deposit of 70% is required to confirm your order and begin production. However, should you cancel your order within 5 business days of placing it (and before production has commenced), you may be entitled to a refund in accordance with Section 17 of the CPA.

2.3 The remaining balance is payable upon completion and prior to delivery or collection.

2.4 We reserve the right to adjust pricing if material costs or other external factors change unexpectedly.

3. Lead Times

3.1 Our estimated production lead time is 10-12 weeks for fully custom furniture, and 8-10 weeks for furniture items listed in our store.

3.2 While we make every effort to meet these timeframes, delays can occur due to external factors (e.g. load shedding, supply chain disruptions).

3.3 We will notify you of any significant delays and, if necessary, offer alternative solutions in accordance with Section 19 of the CPA.

4. Delivery and Collection

4.1 Delivery is available throughout South Africa and quoted separately based on your location and access conditions.

4.2 Delivery includes placement but not installation, unless specifically arranged in advance.

4.3 Risk in the goods passes to you upon delivery or collection.

5. Returns and Refunds

5.1 Due to the bespoke nature of our products, returns or refunds are not accepted in terms of Section 20(3)(c) of the CPA.

5.2 Should your item arrive damaged or defective, please notify us within 48 hours of receipt and include clear photographs. We will assess the issue and, if applicable, repair or replace the item.

5.3 Natural variations in wood grain, tone, or texture are to be expected and are not considered defects.

5.4 Our goal is total client satisfaction — we will always strive to resolve any concerns fairly and promptly.

6. Warranty

6.1 In addition to the statutory 6-month warranty provided under Section 56 of the CPA, we offer a 24-month workmanship warranty on all custom furniture.

6.2 This warranty does not cover damage resulting from misuse, improper care, accidents, or environmental conditions (e.g. moisture or sun exposure).

6.3 All warranty claims must be accompanied by proof of purchase.

6.4 We operate with the mindset that anything is fixable! Please don’t hesitate to reach out with any queries — even if Little Johnny has taken a permanent marker to your new dining table.

7. Intellectual Property

7.1 All designs, drawings, and written content produced by Harris Creations (Pty) Ltd remain our intellectual property unless otherwise agreed in writing.

8. Liability

8.1 Our liability is limited to the value of the goods supplied, in accordance with the limitations permitted under the CPA. We are not responsible for indirect or consequential damages unless otherwise required by law.

9. Governing Law

9.1 These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of South African courts.
